Summary
The Supreme Court considered whether Kerala registration authorities could approve structural changes to vehicles contrary to manufacturer specifications. Construing Section 52 of the Motor Vehicles Act as amended in 2000 with the Central and Kerala Rules, it held that subordinate rules could not authorise changes prohibited by the Act. It set aside the High Court judgment permitting such alterations and directed authorities to apply the circular consistently with that construction.
Issues
- Whether State rules permitted structural alteration contrary to the manufacturer’s original specifications.
- How Section 52, prototype testing and permissible changes to registration particulars operate together.
Provisions considered
- Section 52, as amended by Act 27 of 2000, Motor Vehicles Act, 1988The prohibition on variance from manufacturer specifications was applied with its statutory exceptions and explanation defining alteration by change to basic features. (¶¶ 13, 27, 32, 33)
- Rule 126, Central Motor Vehicles Rules, 1989Prototype testing and certification safeguard fitness and do not confer authority to depart from Section 52. (¶¶ 14, 32)
- Rules 96, 103 and 261, Kerala Motor Vehicles Rules, 1989Inspection, recording of alterations and body-construction powers were held subordinate to Section 52. (¶¶ 16, 32, 33)
Held
- Under the applicable amended Section 52, a vehicle cannot be altered so that registration particulars vary from the manufacturer’s original specifications. Fuel-conversion modifications and specified statutory exemptions remain subject to the prescribed conditions. Changes not affecting basic features fall outside the statutory meaning of alteration. (¶ 27)
- Reporting an alteration under Section 52(3) presupposes a permissible alteration. The subsections must be read harmoniously; reporting does not authorise prohibited structural changes. (¶ 27)
- Compliance with dimensional and other rules is an additional safeguard, not permission to depart from manufacturer specifications protected by Section 52. Other permissible registration particulars may be changed and recorded in accordance with the Act and rules. (¶ 32)
- The High Court incorrectly elevated the State rules over the Act. Circular No.7/2006 must likewise be read consistently with Section 52, and authorities were directed to act accordingly. (¶¶ 33, 34)
Result
Appeals allowed; High Court judgment set aside. Authorities to apply the Act, rules and circular in accordance with the Court’s interpretation.
