Summary
The Court upheld pension entitlement of surplus employees absorbed into RSRTC who timely opted for its pension scheme and whose employee and employer provident-fund contributions had been transferred. No additional capital-value payment from the former employer was required. Equitably modifying relief, the Court required return of CPF benefits including excess gratuity within two months, permitted retention of CPF pension already received, and made the new pension payable only from the deposit date without interest.
Issues
- Whether transferred provident-fund contributions and timely pension options satisfied the absorption scheme.
- Whether a further capital-value transfer could be imposed as a pension condition.
- What refund, commencement and adjustment conditions should govern relief.
Provisions considered
- Regulation 43, Rajasthan State Road Transport Corporation Employees’ Pension Regulations, 1989Required employer contributions to be credited to the pension fund and employee contributions with interest to the GPF fund. (¶¶ 26, 27, 28, 29, 37, 38, 39)
Held
- For the absorbed employees opting for pension, the governing scheme required transfer of employee and employer CPF balances into the corresponding GPF and pension funds. The Provident Fund Commissioner’s completed transfer satisfied that requirement; RSRTC then had to credit the funds and maintain the prescribed pension contribution. (¶¶ 24, 25, 26, 27, 28, 29, 30, 31, 37, 38)
- Neither the pension regulations nor the 1991 absorption circular and 1997 notification required an additional capital amount from the former employer. The 1999 circular’s asserted capital-value condition lacked foundation and could not justify denial of pension. (¶¶ 38, 39, 40)
- Receipt of CPF benefits did not extinguish the established pension entitlement. The employees were required to refund the CPF amounts, including excess gratuity, within two months, without reciprocal interest liability. (¶¶ 41, 42, 46, 47, 49)
- To balance equities, pension under RSRTC’s scheme was payable only from the date of the required deposit. CPF pension already received could be retained and was neither refundable nor deductible from the pension computed under this relief. (¶¶ 49, 50)
Result
Both appeals dismissed subject to modifications: CPF benefits including excess gratuity to be refunded within two months; RSRTC pension payable from deposit date without interest. CPF pension already received may be retained without deduction.
