Summary
The Court upheld statutory development fees but rejected additional planning-authority levies lacking legislative authority. The State’s supervisory directions under section 41 could not create new charges beyond section 15(2-A). Refund with 6% interest was ordered for the successful challengers, subject to adjustment of lawful charges and express limits on the beneficiaries. Betterment charges were left unexamined.
Issues
- Whether development fees and additional inspection, supervision, subdivision and impact charges were authorised.
- Whether State directions under section 41 could supply authority for otherwise unauthorised levies.
- What refund relief should follow.
Provisions considered
- Section 15(2-A), read with section 2, Uttar Pradesh Urban Planning and Development Act, 1973Distinguished the enumerated development fees, mutation charges, stacking fees and water fees from unauthorised additional demands. (¶¶ 6-8, 12-14)
- Section 41, Uttar Pradesh Urban Planning and Development Act, 1973Held the supervisory direction power insufficient to authorise fees not permitted by the Act. (¶ 9-12)
- Article 265, Constitution of IndiaRequired statutory authority for the impugned fiscal levies and rejected charges unsupported by the Act. (¶ 12)
Held
- Malti Kaul governed the validity of development fees. The Court upheld those fees and reversed Rekha Rani to the extent it had invalidated them. The fact that an area within the authority’s jurisdiction was yet to be developed did not by itself defeat that levy. (¶¶ 6, 7, 13)
- Section 15(2-A) authorised the enumerated categories. Section 41 permitted supervisory directions for efficient administration, not creation of new levies beyond the statutory scheme. Inspection or supervision fees for layout sanction, subdivision charges, impact fees and comparable unsupported demands were therefore invalid. (¶ 8-13)
- Amounts paid beyond development fees and the charges authorised by section 15(2-A) were to be refunded with 6% annual interest within twelve months, after adjustment of development fees. Refund was confined to those who challenged the demands and were before the High Court. (¶ 14)
- The Court expressly left betterment charges under section 35 unexamined. Other individual grievances could be pursued through independent High Court proceedings; the judgment did not declare the statutorily listed stacking fees universally invalid. (¶¶ 8, 14)
Result
Appeals disposed of without costs: development fees upheld, unauthorised additional demands set aside, and limited refunds with 6% interest directed within twelve months.
