Summary
The Supreme Court restored promotions of Polytechnic Principals who lacked doctorates but satisfied the alternative experience-based qualifications. The 2010 AICTE Regulations made a Ph.D optional, with different qualifying experience, and the 2016 clarification did not retrospectively make it compulsory. The State rules conformed to those alternatives. Participation by one appointee in drafting the rules did not establish that he controlled the rule-making authority.
Issues
- Whether a Ph.D was compulsory for Polytechnic Principals under the 2010 AICTE Regulations.
- Whether the 2016 notification altered the earlier eligibility conditions retrospectively.
- Whether the rule-drafting committee member’s promotion was vitiated by the alleged conflict of interest.
Held
- The express alternative qualifications had to be given effect. The 2010 Regulations permitted eligible heads of department with or without a Ph.D to become Principals; a doctorate conferred an experience-related advantage rather than being universally mandatory. The State’s fifteen-year route, including three years as head of department, satisfied the alternative. (¶¶ 13, 14, 15, 16, 17, 18, 19, 20, 33)
- Calling a notification clarificatory is not decisive of retrospective effect. No omission or ambiguity in the 2010 alternatives justified using the 2016 answers to impose a new mandatory qualification; the notification reiterated the existing position. (¶¶ 21, 22, 23, 24, 25, 26, 27, 28)
- Accrued service benefits are ordinarily protected against retrospective reinterpretation, while appointments illegal from inception remain correctable. These appointees possessed an existing alternative qualification and their promotions were to remain undisturbed. (¶¶ 29, 30, 31, 32, 33)
- Membership of the drafting committee alone did not show influence over the constitutional rule-making authority. The appointee’s position supplied no basis to infer dominance in the decision. (¶ 34)
Result
Appeals allowed; High Court judgment set aside and writ petition challenging the promotions dismissed. No order as to costs.
