Summary
Sri Udasin Mutt's inam land at Kukatpally, Hyderabad, about 540 acres, was leased between 1964 and 1978 to Indian Detonators, whose successor Gulf Oil used it for industrial purposes. The Endowments Tribunal held that Section 82(1) of the 1987 Endowments Act had statutorily cancelled the leases as leases of agricultural land not held by landless poor persons, and ordered eviction. The High Court upheld this but directed consideration of a continued lease under Rule 15 of the 2003 Rules. The Supreme Court dismissed Gulf Oil's appeals and allowed the Mutt's. Section 82(1) turns on the nature of the land, not its use. A Joint Collector's finding under the Inams Abolition Act created no estoppel. The lessee knew agricultural character was in issue, so the absence of a specific pleading was not fatal. Rule 15 does not apply to agricultural land.
Issues
- Whether leases of an endowment's inam land used for industrial purposes stood statutorily cancelled under Section 82(1) of the Telangana Charitable and Hindu Religious Institutions and Endowments Act, 1987 as leases of 'agricultural land'
- Whether a Joint Collector's finding under the Inams Abolition Act that the land was used for non-agricultural purposes operated as estoppel
- Whether the absence of a specific pleading or issue on the land being agricultural vitiated the Tribunal's finding
- Whether Rule 15 of the 2003 Rules could be applied to continue the lease
Provisions considered
- Sections 75 and 82(1), (3) and (4), Telangana Charitable and Hindu Religious Institutions and Endowments Act, 1987Leases of agricultural land of an endowment held by persons other than landless poor persons stood cancelled, whatever the use. Prior Government sanction is relevant only under Section 75, not as an exception to Section 82. (¶¶ 8, 10, 57, 60, 69)
- Sections 1(2)(i), 4(1) proviso and 9, Telangana Abolition of Inams Act, 1955The Act did not apply to inams of religious institutions. A Joint Collector's finding on non-agricultural use, made in a proceeding brought by an attorney claiming independently, was not res judicata or estoppel under the 1987 Act. (¶¶ 9, 45, 46, 47, 49, 50)
- Rule 15, Telangana Charitable and Hindu Religious Institutions and Endowments Immovable Properties and other Rights (Other than Agricultural Land) Leases and Licenses Rules, 2003Rule 15 applies only to property other than agricultural land under Section 82(3) and (4), so the High Court's direction to consider continuing the lease under it was untenable. (¶¶ 40, 72)
Held
- Section 82(1) refers to the nature of the land, not its use. Agricultural land does not lose that character because the lessee uses it for industrial purposes. Inclusion within municipal or urban-agglomeration limits or a zonal development plan does not change that either, and no non-agricultural assessment had been paid. The revenue records described the land as dry agricultural land, and Siddhartha Academy is followed. (¶¶ 29, 57, 58, 60, 61, 70, 71)
- The Joint Collector's finding was made under a special statute of limited jurisdiction, in proceedings brought by an attorney claiming independently and not between the same parties. The Inams Abolition Act did not apply to the Mutt at all. That finding therefore creates no res judicata or issue estoppel. (¶¶ 47, 48, 49, 50)
- The inspection reports, the Mutt's counter-affidavit and the High Court's earlier order in the lessee's own writ petition all put the land's agricultural character and the statutory cancellation in issue, and the Tribunal framed an issue on subsistence of the leases under Section 82. The parties went to trial knowing the controversy, and strict CPC pleading rules do not bind a statutory Tribunal. (¶¶ 51, 52, 53, 54, 55, 62, 63, 64, 65, 66)
- A 1964 file noting was not a communicated decision and conferred no approval (Bachhittar Singh, Sethi Auto). In any case, approval under Section 75 does not save a lease from cancellation under Section 82. (¶¶ 67, 68, 69)
Result
Gulf Oil's appeals dismissed and the eviction upheld; the Mutt's appeal allowed, setting aside the direction to consider continuation of the lease under Rule 15 of the 2003 Rules.
