Summary
The Court held that gallonage fee, licence fee and shop rental for both FL-9 and FL-1 licences were disallowable under Section 40(a)(iib) of the Income-tax Act. Exclusivity was assessed by the State-owned character of the undertakings subjected to the levy, rather than whether only one undertaking held the licence. Sales-tax surcharge and turnover tax remained outside that provision because they were taxes, not the specified fees or charges. The assessee’s appeal was dismissed, the Revenue’s appeals partly allowed, and revised assessments directed within two months of receipt of the judgment.
Issues
- Whether licence-related levies lost their exclusive character because another State undertaking also held FL-1 licences.
- Whether sales-tax surcharge and turnover tax were disallowable as fees, charges or appropriations under Section 40(a)(iib).
Provisions considered
- Section 40(a)(iib)(A) and (B), including its Explanation, Income-tax Act, 1961Both sets of licence-related fees were disallowable, but the provision did not extend to the sales-tax surcharge and turnover tax. (¶¶ 7, 13-17)
- Section 3(1), Kerala Surcharge on Taxes Act, 1957Surcharge increased the underlying sales tax and retained its character as tax. (¶ 14.3-14.5)
Held
- Section 40(a)(iib) was introduced to prevent erosion of State-undertaking taxable profits through exclusive levies or appropriations to the State treasury. Its interpretation had to preserve that legislative purpose. (¶¶ 7, 13-14)
- For the licence fees at issue, exclusivity depended on the character of the undertakings subjected to the levy, not their number. Both KSBC and the other FL-1 licensee were State undertakings; licensing an additional State undertaking did not remove the disallowance. Gallonage fee, licence fee and shop rental under both FL-9 and FL-1 therefore fell within the provision. (¶¶ 14-14.2, 16)
- The statutory expression covering specified fees and charges did not include a tax or surcharge on tax. Treating the sales-tax surcharge as either a fee under clause (A) or an appropriation under clause (B) would erase the legislature’s deliberate distinction between taxes and fees. (¶ 14.3-14.5)
- The surcharge was an enhancement of the underlying sales tax and retained that character. The same reasoning excluded turnover tax from Section 40(a)(iib); the Revenue’s request to leave that issue for further adjudication was not accepted. (¶ 14.4-16)
- Assessments for 2014-15 and 2015-16 remained set aside. The assessing officer was directed to recompute liability consistently with these conclusions and pass revised orders within two months of receiving the judgment. (¶ 17)
Result
Assessee’s appeal dismissed; Revenue’s appeals partly allowed concerning FL-1 fees; tax and surcharge disallowances rejected; revised assessments directed within two months of receipt.
