Summary
The Supreme Court upheld the exclusion of candidates holding a Diploma in Computer Applications or other computer-related 'higher' qualifications from selection to Lower Division Clerk posts in the Kerala Water Authority, holding that the Special Rules allowed equivalence only of the institution awarding the prescribed Data Entry certificate, not of the qualification, and that the KPSC never assessed whether those qualifications presupposed the prescribed one. It censured the KPSC for its shifting stand.
Issues
- Whether candidates with a Diploma in Computer Applications or other computer-related degrees and diplomas were eligible for the post of LDC when the prescribed qualification was a Certificate in Data Entry and Office Automation from a named or similar/equivalent Government-approved institution.
- Whether such qualifications could be accepted under Rule 10(a)(ii) of the Kerala State and Subordinate Service Rules, 1958 as qualifications presupposing the prescribed lower qualification.
- Whether the writ petitions failed for non-impleadment of all affected candidates under Rule 148 of the Kerala High Court Rules.
- Whether the KPSC could reverse the stand it had taken in the earlier round of litigation.
Provisions considered
- Rule 10(a)(ii), Part II, Kerala State and Subordinate Service Rules, 1958Read as overriding the Special Rules but its first part applies only where the Special Rules provide for equivalent qualifications, which they did not for LDC; its second part, on qualifications presupposing the lower prescribed qualification, required an actual assessment that the KPSC never undertook. (¶¶ 13, 14, 17, 21, 22)
- Rule 2, Part II, Kerala State and Subordinate Service Rules, 1958Provides that Special Rules prevail over repugnant General Rules; hence the Kerala Water Authority Rules of 2011 govern the qualification for LDC, subject only to Rule 10(a)(ii). (¶ 13)
- Category No. 27, Wing II (qualification for LDC); Rules 6 and 10, Kerala Water Authority (Administrative, Ministerial and Last Grade) Service Rules, 2011The equivalence clause refers only to the institution issuing the Data Entry and Office Automation certificate; since the Rules expressly allow equivalent qualifications for other posts but not for LDC, eligibility was deliberately not enlarged. Rules 6 and 10 import the 1958 Rules only for reservation and employee service conditions. (¶¶ 12, 13, 15, 16, 17)
- Rule 148, Kerala High Court RulesRequires all directly affected persons to be impleaded, or representative impleadment with notice where they are numerous; held satisfied since 101 affected candidates were parties and none could be unaware of the long litigation. (¶ 11)
Held
- The equivalence in the qualification for LDC relates to the institution awarding the Certificate in Data Entry and Office Automation, not to the qualification itself. Since the 2011 Rules expressly accept equivalent qualifications for other posts but not for LDC, a qualification equivalent to the certificate was not acceptable, and the first part of Rule 10(a)(ii) was not attracted. (¶¶ 15, 16, 17)
- A computer-related degree or diploma cannot be assumed to presuppose the prescribed certificate. The KPSC had to examine the curricula and the actual hours of data entry and office automation training before treating any qualification as higher; having done no such exercise, it could not accept those candidates. Ajith K v. Aneesh K.S. was followed and Jyoti K.K. v. KPSC distinguished. (¶¶ 21, 22, 23)
- The non-impleadment objection failed: Rule 148 aims to protect affected persons ignorant of the litigation, and with 101 affected candidates on record and a dozen years of litigation, their collective interest was sufficiently represented. (¶ 11)
- A statutory selection body cannot blow hot and cold. Having firmly maintained in the earlier round that DCA holders were ineligible, the KPSC's later reversal without any foundational inquiry was whimsical and arbitrary; consistency and predictability are facets of the rule of law and Article 14, and the KPSC was censured for making statements contrary to its earlier sworn affidavits. (¶¶ 18, 20, 24, 25, 26, 27)
Result
Appeals dismissed; the High Court's direction to recast the ranked list excluding candidates without the prescribed qualification upheld. Parties to bear their own costs.
