Summary
Engineering degree holders were eligible to compete in the disputed HPSEB Junior Engineer recruitment. Read as a whole, the rules contemplated entrants who already held degrees, including a distinct promotional sub-quota for them. The June 2020 amendment clarified that position and applied to the pending recruitment despite prospective commencement. The Court directed consideration of all participating applicants on relative merit, without guaranteeing selection to any degree holder.
Issues
- Whether the diploma qualification in the applicable HPSEB rules excluded engineering degree holders.
- Whether the June 2020 amendment applied to the disputed recruitment.
Provisions considered
- Junior Engineer qualification in column 7; Assistant Engineer promotional column 11(v), HPSEB Recruitment and Promotion RegulationsThe qualification and promotion scheme, read together, contemplated degree holders entering as Junior Engineers. (¶¶ 18-19, 29-32, 37)
- Amendment dated 3 June 2020, HPSEB Recruitment and Promotion RegulationsThe higher-qualification clarification applied to the recruitment in dispute notwithstanding prospective enforcement. (¶¶ 21, 33-35, 38)
Held
- Eligibility depends on the particular rules, their scheme and the post. Earlier decisions excluding B.Ed. holders from primary teaching or diploma holders from an ITI-based technician post did not establish a universal bar against higher qualifications. Nor did the Court announce that every higher qualification automatically satisfies every prescribed qualification. (¶¶ 22-28, 37)
- The minimum requirement combined matriculation with the technical qualification; the word “with” was conjunctive. The entire regulatory scheme, including separate 5% promotional sub-quotas for those obtaining degrees during service and those holding degrees before joining as Junior Engineers, demonstrated that degree holders were not excluded from entry. (¶¶ 29-32, 37)
- The 2020 amendment cleared existing doubts rather than creating the relevant eligibility for the first time. Its clarificatory character allowed it to govern the disputed recruitment even though brought into force prospectively. (¶¶ 33-35, 38)
- HPSEB was to process all applicants who had participated, including degree holders, and issue the final selection list after interviews and other required steps according to relative merit. Eligibility for consideration did not itself confer appointment. (¶ 39)
Result
High Court judgment set aside; degree holders’ appeals allowed and writ petition partly allowed. HPSEB directed to complete selection considering all participating applicants, including degree holders. No costs.
