Summary
When 38 villages of the Pune Zilla Parishad were merged into the Pune Municipal Corporation in 1999, primary teachers serving there were absorbed into the Corporation. Its 2018 seniority list counted their seniority only from absorption, ignoring their Zilla Parishad service, and an association of directly recruited municipal teachers defended that list; the Bombay High Court held that prior service must count. The Supreme Court dismissed the association's appeal: Section 3(3)(b) of the Maharashtra Municipal Corporation Act, 1949 merely extends existing municipal rules to the added area and says nothing about service conditions, whereas Section 493 read with the first proviso to Clause 5(c) of Appendix IV deems prior service to be service in the Corporation, consistent with a 1990 Government Resolution, and no estoppel arose since the cause of action accrued only with the final list.
Issues
- Whether service rendered by primary teachers in a Zilla Parishad before the merger of their villages into a Municipal Corporation counts towards their seniority after absorption, and whether that question is governed by Section 3(3)(b) or by Section 493 read with Appendix IV of the Maharashtra Municipal Corporation Act, 1949.
Provisions considered
- Section 3(3)(b), Maharashtra Municipal Corporation Act, 1949Provides only that appointments, notifications, rules and the like in force in the existing larger urban area apply to the newly included area so that it is not left in a vacuum; it is not concerned with protecting the service conditions of absorbed employees, so reliance on it was misplaced. (¶¶ 15, 16, 17)
- Section 493 read with Clause 5(c) of Appendix IV, Maharashtra Municipal Corporation Act, 1949Officers and servants of the municipality or local authority immediately before the appointed day become employees of the Corporation, and the first proviso deems their earlier service to be service rendered in the Corporation; this unambiguous provision occupies the field and requires the Zilla Parishad service to count for seniority. (¶¶ 18, 19, 20, 21, 22)
- Articles 162 and 243Q(2), Constitution of IndiaThe State specifies a larger urban area by notification under Article 243Q(2); the Government Resolution of 13 August 1990, never rescinded, directs that Zilla Parishad service of transferred primary teachers be counted for pay, seniority and retiral benefits, and later inter-departmental letters are of no legal consequence. (¶¶ 3, 6, 7)
Held
- Clause 5 of Appendix IV deals with continuation of appointments, and the word continuation connotes an unbroken state; the service of the absorbed teachers in the Zilla Parishad therefore remains in existence after absorption by force of the statutory protection, and the High Court rightly directed that their seniority be reckoned from their initial appointment. (¶¶ 20, 21, 22)
- The five-member committee of the Corporation was not competent to recommend anything contrary to the 1990 Government Resolution, and the cause of action arose only when the final seniority list was published in February 2018, which the teachers promptly challenged; there was no acquiescence, delay or laches. (¶ 23)
Result
Appeal dismissed; Bombay High Court judgment dated 01.10.2021 directing that the seniority of primary teachers absorbed from the Pune Zilla Parishad be counted from their initial appointment in Zilla Parishad schools affirmed; pending applications disposed of.
