Summary
Promotee Excise and Taxation Officers were given seniority from earlier promotional-quota vacancies although they had never worked in those higher posts before their regular promotion. The Court held that the J&K rules required both an available vacancy and actual service against the higher post. It restored the Single Judge’s decision rejecting retrospective promotion and seniority.
Issues
- Whether promotional-quota vacancies alone justified backdated promotion and seniority over direct recruits.
Provisions considered
- Rules23 and24, Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules,1956Retrospective appointment requires an existing vacancy and continuous duty in the relevant service; seniority relates to first appointment in that service or cadre. (¶¶ 4, 12–18)
- Rule9 explanation, Jammu and Kashmir Excise and Taxation (Gazetted) Recruitment Rules,1977Officiating duty can count toward probation upon formal appointment, requiring actual work on the ETO post. (¶¶ 4, 13–18)
Held
- Ordinarily seniority begins on entry into the particular cadre. Retrospective appointment is possible only where rules enable it and their conditions are met. Earlier eligibility or existence of quota vacancies does not itself confer seniority. (¶ 8–12)
- Under the combined rules, a promotee can receive credit for earlier temporary, officiating or ad hoc service against an existing promotional-quota vacancy, but cannot receive a date earlier than actual work in the higher post. Suraj Prakash Gupta involved such prior service and did not support backdating these appointments. (¶¶ 5–7, 12–17)
- Holding a pensionable post in the feeder category did not make the respondents members of the separate gazetted ETO cadre. They had never worked as ETOs before promotion, so the retrospective dates prejudicing direct recruits were impermissible. (¶ 15–20)
Result
Appeals allowed; Division Bench judgment set aside and the Single Judge’s decision rejecting the promotees’ retrospective promotion and seniority restored.
