Summary
The Supreme Court reversed a murder conviction because material contradictions and evidentiary weaknesses created reasonable doubt. The main witnesses had a demonstrated property dispute with the accused; independent witnesses did not support the prosecution account, and the arrest, recovery, complaint and hospital evidence contained substantial inconsistencies. Relationship alone does not discredit testimony, but the lower courts failed to scrutinise these witnesses’ evidence with the care warranted by the facts. Release was ordered unless required in another case.
Issues
- Whether the interested witnesses’ testimony reliably supported the conviction.
- Whether contradictions and weaknesses concerning presence, arrest, recovery and medical history created reasonable doubt.
Held
- Related and interested witnesses are not interchangeable categories, and relationship alone does not impair credibility. Even interested testimony may sustain a conviction without corroboration if careful scrutiny establishes its truth. Here the central witnesses’ pecuniary interest in the property dispute required particular caution on the actual evidence. (¶¶ 16, 17, 18)
- Independent witnesses did not support the claimed eyewitness account, and arrest-and-recovery witnesses denied the prosecution version. The record raised substantial questions about the principal witness’s presence, the movement of the deceased to hospital, the recorded history of a fall, recovery of material objects and the manner of lodging the complaint. These were material defects rather than harmless variations. (¶¶ 14, 15, 19, 20)
- The lower courts failed properly to evaluate the cumulative weaknesses and possible motive for false implication. The resulting reasonable doubt was practical rather than speculative, and guilt had not been proved by cogent evidence beyond reasonable doubt. Concurrent conviction therefore required reversal. (¶¶ 21, 22, 23)
