Summary
The Court set aside anticipatory bail granted to four in-laws in a case concerning an unnatural death within seven years of marriage. The High Court had misread specific allegations of dowry demands and assaults as general and relied on unsupported inferences from the accused’s means. Serious investigative deficiencies, including failure to probe the murder allegation and unexplored financial and telephone evidence, justified further investigation by the CBI despite a filed chargesheet. All observations on guilt remained prima facie.
Issues
- When an unjustified anticipatory-bail order may be set aside without subsequent misconduct.
- Whether serious investigative deficiencies warranted CBI further investigation after the chargesheet.
Provisions considered
- Section 438, Code of Criminal Procedure, 1973Anticipatory-bail discretion requires assessment of the offence, attributed role, material circumstances and the interests of a fair investigation; contrary-to-record reasoning warranted interference. (¶ 14–19)
- Article 142(1), Constitution of IndiaThe Court directed CBI further investigation to secure justice in the exceptional circumstances despite submission of the chargesheet. (¶ 21–25)
Held
- Setting aside an unjustified, illegal or perverse bail order differs from cancellation for supervening misconduct. Ignoring material circumstances or giving reasons contrary to the record permits superior-court intervention without new misconduct. (¶ 15–18)
- The FIR contained specific allegations against the accused, earlier assault allegations, financial transfers and recent calls concerning demands and threats. Treating it as engineered or devoid of specific roles, and inferring innocence from financial means or absence of external injury, lacked a proper basis. Grant of anticipatory bail on that approach could obstruct investigation. These observations did not determine guilt. (¶¶ 12–14, 19)
- Transfer of investigation is extraordinary and must be used sparingly. A chargesheet does not remove the constitutional court’s power where a tainted or deficient investigation creates a real likelihood of failure of justice. Uninvestigated murder allegations, the disputed note, unexplored money trail and call history, and the authorities’ inconsistent stance justified CBI further investigation here. (¶ 20–25)
- Selective disclosure of investigative material can undermine both the presumption of innocence and the interests of victims’ families. Publication of an alleged suicide note did not justify expecting the bereaved family to examine media accounts before reporting the offence. (¶ 20)
