Summary
The Court held that the Sikkim excise exemption notification did not exempt National Calamity Contingent Duty, education cess or secondary and higher education cess imposed under separate Finance Acts. Incorporation of excise-law exemption machinery supplied a power to exempt, rather than an automatic exemption. Following Modi Rubber and Rita Textiles, the Court declared SRD Nutrients and Bajaj Auto per incuriam for overlooking binding larger-Bench precedents and upheld dismissal of the manufacturers’ claims.
Issues
- Whether Notification No. 71/2003-CE exempted separately imposed NCCD and education cesses.
- Whether incorporation of excise exemption provisions or the decisions in SRD Nutrients and Bajaj Auto required extension of the exemption.
Provisions considered
- Section 136, Finance Act, 2001NCCD was an additional levy; application of Central Excise Act machinery did not itself exempt it under the notification. (¶¶ 18, 38, 40, 41)
- Sections 91 and 93, Finance (No. 2) Act, 2004The education cess was not covered by the earlier notification; the incorporated exemption machinery required an applicable exemption notification. (¶¶ 19, 40, 41)
- Sections 126 and 128, Finance Act, 2007The later secondary and higher education cess required its own applicable exemption and did not automatically follow the exemption for named excise duties. (¶¶ 20, 40, 41)
Held
- The exemption notification named duties under the 1944, 1957 and 1978 Acts. It did not include NCCD under the Finance Act, 2001, or the education cesses imposed subsequently in 2004 and 2007. Their character as excise duties did not enlarge that notification. (¶¶ 17, 18, 19, 20, 24, 40)
- Statutory adoption of excise-law refund and exemption provisions provided a source of exemption power. An applicable notification was still necessary; exemption of one duty did not automatically exempt separate duties or cesses. (¶¶ 32, 36, 37, 38, 40, 41)
- The relied-on administrative circulars could not bind the Court’s statutory interpretation. Exemption of basic excise duty did not prevent computation of separate additional duties or require treating them as automatically extinguished. (¶ 41)
- SRD Nutrients and Bajaj Auto had overlooked the binding three-Judge decisions in Modi Rubber and Rita Textiles and were per incuriam. The Court followed those coordinate-Bench precedents. (¶¶ 28, 38, 42, 43)
Result
