Summary
Retired Manipur college staff claimed revised pension from 1 April 2010 under the State pension regime adopted for them. A later administrative clarification deferred actual benefit to 1 November 2010. The Court held that the governing orders had placed the retirees within the general pension rules without reserving a different commencement date. The clarification could not displace that acquired entitlement, and the Single Judge’s grant of relief was restored.
Issues
- Whether revised pension for the appellants commenced on 1 April or 1 November 2010 under the governing Manipur orders.
- Whether the later administrative clarification could postpone the entitlement already conferred.
Provisions considered
- OM dated 5 May 2010, clause 3.1; order dated 12 August 2011, clauses 7 and 8, Government of Manipur pension and college-pay ordersRead together, these instruments placed the appellants in the State pension regime with actual revised pension from 1 April 2010. (¶¶ 4, 6, 12-16)
- OM dated 24 December 2011, Government of ManipurThe administrative clarification could not override the substantive entitlement conferred by the earlier instruments of statutory strength. (¶¶ 7, 15-16)
Held
- The August 2011 order prescribed the computation of pension and adoption of the general State pension rules, but did not specify a different commencement date for the retirees’ revised pension. Their migration to that regime was not excluded expressly or by implication. (¶ 12-13)
- Once placed in the general pension regime, their former service category and higher pension quantum did not alter the applicable commencement date. The distinct date for serving college employees was not a sufficient basis to postpone the retirees’ entitlement. (¶¶ 14, 16)
- The December 2011 memorandum was administrative and sought to withdraw an acquired substantive benefit. Characterising it as clarification could not permit it to override the governing orders’ statutory strength. It was not binding insofar as it deferred these appellants’ revised pension beyond 1 April 2010. (¶ 15-16)
Result
Appeal allowed without costs; the Division Bench’s judgment was set aside and the Single Judge’s 30 October 2015 judgment restored and affirmed. The appellants were entitled to revised pension from 1 April 2010. Pending applications disposed of.
