Summary
The Supreme Court held that an arbitral award may be presented directly for execution wherever in India it can lawfully be executed, without first filing it before the court having jurisdiction over the arbitration and obtaining a transfer. Section 36 supplies the decree-enforcement mechanism but does not turn the award into a decree passed by that court. The execution application before the Morena courts was restored.
Issues
- Whether execution of an arbitral award required prior filing and transfer from the court having jurisdiction over the arbitration.
Provisions considered
- Section 36(1), Arbitration and Conciliation Act, 1996The award is enforced as if it were a decree, without being a decree passed by a particular civil court. (¶¶ 14, 15, 21, 22)
- Sections 32 and 42, Arbitration and Conciliation Act, 1996Final award terminates arbitral proceedings; Section 42’s rule for applications concerning those proceedings does not govern execution of the award. (¶¶ 17, 18, 19, 20)
- Sections 38, 39 and 46, Code of Civil Procedure, 1908Provisions concerning the court which passed a decree do not require prior filing and transfer of an arbitral award from the court of arbitration jurisdiction. (¶¶ 7, 8, 9, 10, 20, 21)
Held
- An award under the 1996 Act is executable using the Code’s mechanism as if it were a decree; no civil court first passes a decree upon it. There is no fiction deeming the court where the award was made to be the court which passed the decree, and the arbitral tribunal itself has no decree-execution power. (¶¶ 10, 14, 15, 21)
- Section 42 does not apply to the execution application: arbitral proceedings have terminated upon the final award under Section 32, and execution is not an arbitral proceeding. (¶¶ 17, 18, 19, 20)
- Execution may be filed anywhere in the country where the award can be executed without obtaining a decree transfer from the court having jurisdiction over the arbitral proceedings. The contrary Madhya Pradesh and Himachal Pradesh High Court views were disapproved. (¶¶ 22, 23)
Result
Appeal allowed; order returning the execution application set aside and the application before the Morena courts restored. Parties to bear their own costs.
