Summary
A three-judge Bench held that neutral substances forming part of a seized narcotic-drug or psychotropic-substance mixture must be included when determining small or commercial quantity. It rejected the contrary rule in E. Micheal Raj and upheld the 2009 notification adding Note 4 as clarificatory. Section 21 must be read with the statutory scheme and notifications. Individual appeals were left for merits decisions by the appropriate court.
Issues
- Whether quantity classification depends on pure drug content or the total mixture including neutral material.
- Whether E. Micheal Raj remained good law.
- Whether the 2009 notification adding Note 4 exceeded the statutory scheme.
Provisions considered
- Section 21, Narcotic Drugs and Psychotropic Substances Act, 1985Required the punishment provision to be read with the statutory scheme and quantity notifications rather than as a standalone provision. (¶¶ 8.2, 8.4, 10)
- Note 2 and Entry 239, Notification S.O. 1055(E), dated 19 October 2001Read the quantity thresholds as applicable to preparations and mixtures, including neutral material. (¶¶ 6.3, 6.4, 7.1, 8.2)
- Note 4 added to the 2001 quantity notification, Notification S.O. 2942(E), dated 18 November 2009Upheld the provision applying notified quantities to the entire mixture or solution, not merely pure drug content, as clarificatory and within the statutory scheme. (¶¶ 6, 9, 9.1, 10)
Held
- When a narcotic drug or psychotropic substance is seized mixed with neutral substances, their weight is included with the offending drug in determining small or commercial quantity. The contrary pure-content rule in E. Micheal Raj is not good law. (¶¶ 6.3, 6.4, 7, 7.1, 8.2, 8.3, 8.4, 10)
- The statutory treatment of preparations and the quantity notification must be read together. The 2001 rationalisation of punishment did not establish an intention to exclude neutral material. For mixtures governed by Entry 239, the Court explained application of the lesser relevant thresholds of the constituent drugs to the mixture. (¶¶ 6.4, 7, 7.1, 8.2, 8.4)
- Section 21 is not standalone and must be construed with the other provisions and the 2001 and 2009 notifications. Note 4 clarified the existing scheme by abundant caution; inclusion of neutral material did not depend on its addition, and the notification was not ultra vires. (¶¶ 9, 9.1, 10)
- The Court answered the reference without deciding individual appeals on their factual merits. Those appeals were to be listed before the appropriate court for decisions consistent with the reference ruling. (¶ 11)
Result
Reference answered. Writ petitions and Civil Appeal No. 5218/2017 challenging the notification dismissed; remaining individual appeals directed to the appropriate court for decision on merits. Intervention application disposed of.
