Summary
A Single Judge of the Delhi High Court held CRPF officers guilty of contempt and gave them time to promote the respondent, a removed-and-reinstated officer, to the rank of IG. The Division Bench held the Letters Patent Appeal not maintainable because no punishment had been imposed. The Supreme Court held that the Single Judge's order also contained a crystallised finding on the merits, entitlement to promotion as IG, which is open to intra-court appeal under Midnapore Peoples' Coop. Bank, and restored the appeal.
Issues
- Whether a Letters Patent Appeal lay against a contempt order of a Single Judge that found wilful disobedience but imposed no punishment, where the order also determined the employee's entitlement to promotion.
Provisions considered
- Section 19, Contempt of Courts Act, 1971Following Midnapore Peoples' Coop. Bank Ltd. v. Chunilal Nanda, an appeal under Section 19 lies only against an order imposing punishment for contempt; the finding of guilt without sentence was therefore not appealable under it at that stage. (¶¶ 11, 13, 14, 15, 18)
- Article 136, Constitution of IndiaNoted in the Midnapore principles as the route to challenge directions on the merits made in contempt proceedings where no intra-court appeal is available. (¶ 13)
Held
- An appeal under Section 19 of the Contempt of Courts Act, 1971 lies only against an order imposing punishment for contempt. A finding that the alleged contemnors are guilty, without punishment, is not appealable under Section 19 at that stage. (¶¶ 13, 14, 15, 18)
- In contempt proceedings the High Court should not decide the merits of the dispute. If it does decide an issue or give a direction on the merits, the aggrieved party may challenge that part in an intra-court appeal where the order is of a Single Judge and such an appeal is provided, or otherwise under Article 136. (¶¶ 13, 18)
- Whether an appeal is maintainable is judged on a plain reading of the Single Judge's order. Here the order, read as a whole, recorded the employee's claim to promotion as IG, found wilful disobedience on that basis, and gave the officers time to issue an order promoting him to IG at par with his immediate junior. It thus contained a crystallised finding that he was entitled to that promotion. (¶¶ 15, 16, 17, 18)
- The Division Bench erred in reading the Single Judge's order as deciding only the question of contempt. The finding on entitlement to promotion was amenable to a Letters Patent Appeal under principle V of Midnapore, though the finding of contempt itself was not appealable under Section 19 at the present stage. (¶¶ 18, 19)
Result
Appeals allowed; Division Bench judgment dated 10 May 2024 set aside and the Letters Patent Appeal with its applications restored for decision on merits; contentions on merits kept open; on the respondent's statement, no coercive steps against the appellants until the next listing; High Court requested to decide the appeal expeditiously.
