Summary
Applications sought implementation of earlier directions concerning absorption of LIC’s temporary, badli and part-time workers. The Court found serious defects in the Dogra verification report and conflicts between the 2015 decision and earlier binding decisions and schemes. Balancing finality, equal opportunity in public recruitment and decades of litigation, it used Article 142 to direct fresh verification for the specified 1985–1991 cohort and compensation at Rs.50,000 per year of service or part thereof in full settlement, in place of absorption.
Issues
- How conflicting earlier decisions, statutory recruitment rules and the finality of the 2015 judgment should be reconciled.
- Whether the Dogra Report established entitlement and which workers could receive relief.
- What final relief should replace prolonged claims to absorption.
Provisions considered
- Section 48(2)(cc), (2A), (2B) and (2C), Life Insurance Corporation Act, 1956The deemed statutory service rules had overriding force where inconsistent with the Industrial Disputes Act; their effect and earlier binding interpretations could not be disregarded. (¶ 61-71)
- Regulation 8, Life Insurance Corporation of India (Staff) Regulations, 1960Temporary appointment alone did not confer absorption or recruitment preference, although absorption under a valid scheme on specified conditions was not absolutely barred. (¶¶ 1, 70-71)
- Section 18(3)(d), Industrial Disputes Act, 1947The provision extending an award to subsequent employees could not override Section 48(2C) and confer automatic absorption on workers recruited after 4 March 1991. (¶ 71)
- Articles 14, 16 and 142, Constitution of IndiaEqual opportunity in public recruitment and the finality of earlier litigation were balanced by fresh verification and compensation in place of absorption. (¶¶ 56-57, 72-75)
Held
- The 2015 decision overlooked the final order substituting compromise terms for the Tulpule and Jamdar awards and took a position inconsistent with the earlier larger-Bench decision in E Prabavathy and its subsequent application. While acknowledging finality after review and curative proceedings, the Court harmonised the conflicting directions through Article 142 rather than permitting mass absorption inconsistent with open public recruitment. (¶¶ 53-57, 69, 73-74)
- The Dogra Report’s task was verification, not fresh adjudication. It inadequately verified service, contained inconsistencies and included workers governed by the separate E Prabavathy order despite their exclusion from the relevant award. It could not sustain the proposed absorption exercise. (¶¶ 58-60, 74)
- Regulation 8 barred an entitlement to absorption merely from temporary appointment, not every claim under a valid absorption scheme. Its deemed-rule status and statutory overriding force prevented post-4 March 1991 recruits from claiming automatic absorption through Section 18(3)(d). (¶ 70-71)
- Fresh independent verification was confined to workers engaged between 20 May 1985 and 4 March 1991 who met the threshold of 85 days in Class III over two years or 70 days in Class IV over three years. Verification was not confined to the CGIT certified list and had to proceed independently of the flawed Dogra Report, using LIC’s divisional records and material supplied by workers or their representatives. (¶¶ 75(i)-(ii), 75(iv)-(vii))
- Eligible verified workers were to receive Rs.50,000 for every year of service or part thereof, in lieu of reinstatement, regularisation or absorption and in full and final settlement of their claims, notwithstanding the earlier directions in TN Terminated Employees Association. No automatic absorption or unconditional acceptance of all claims was ordered. (¶ 75(iii))
Result
Miscellaneous applications and writ petitions disposed of under the Article 142 directions. A committee of Justice P.K.S. Baghel and Rajiv Sharma was appointed for fresh verification. LIC must provide records, logistical support and expenses, and pay compensation within three months of receiving the verification report. Pending applications disposed of.
