Summary
The Court set aside an award of pensionary benefits to an Army Medical Corps officer as a late entrant. His request was a resignation, not voluntary retirement, and he had not left on reaching the prescribed compulsory-retirement age. Regulation 15’s concession for officers retiring at that age with at least 15 years’ qualifying commissioned service therefore did not apply. The 2008 Regulations could not retrospectively supply additional reckonable service, and the contrary Tribunal order was quashed.
Issues
- Whether the officer’s resignation could be treated as voluntary retirement for pension entitlement.
- Whether he qualified as a late entrant under Regulation 15 of the 1961 Pension Regulations.
- Whether the 2008 Regulations could support additional qualifying service.
Provisions considered
- Regulations 15 and 25(a), Pension Regulations for the Army, 1961The ordinary retiring-pension qualification was 20 years. The late-entrant concession required retirement on reaching the prescribed age limit with at least 15 years of actual qualifying commissioned service; the resigning officer did not satisfy that condition. (¶¶ 5.1, 10, 11, 12)
Held
- The application and the officer’s earlier litigation consistently concerned resignation. At the time of applying he lacked the service needed to seek voluntary retirement under the applicable policy. Recasting the request as voluntary retirement to obtain the late-entrant concession was an afterthought. (¶¶ 5.1, 6)
- Resignation and voluntary retirement have different service-law consequences. A beneficial interpretation of a pension scheme cannot override its express conditions or include excluded categories by implication. (¶¶ 7, 8, 8.1)
- The reliance on the 2008 Regulations to count pre-commission service and ante-date seniority had not been raised before the High Court or Tribunal. Those Regulations did not apply retrospectively to this officer, whose resignation had been accepted before they came into force; the applicable 1961 provisions were not equivalent. (¶ 9)
- The precedent concerning an officer who had completed the requisite pensionable service did not assist this officer. Regulation 15 required retirement at the prescribed age limit, not merely completion of 15 years after entering service late. Since he resigned before that age, the Tribunal’s direction to process benefits as a late entrant could not stand. (¶¶ 10, 11, 12)
Result
Union’s appeal allowed without costs. Tribunal order quashed; respondent held ineligible for terminal/pensionary benefits as a late entrant under Regulation 15.
