Summary
SAIL took Modvat credit on capital goods for a 'Guide Car' used to transport hot coke discharged from its coke oven battery. The Revenue held the Guide Car classifiable under sub-heading 8603.00, as finally classified at the supplier's end, and so outside the capital goods eligible under Rule 57Q of the Central Excise Rules, 1944. The Tribunal confirmed a demand of about Rs. 45.87 lakh and reduced the penalty to Rs. 1 lakh. The Supreme Court upheld the denial of credit. Classification at the consignor's end is final and cannot be questioned by the consignee. The Guide Car is not a 'component' of the coke oven battery, because the battery functions without it and it is separate equipment used afterwards. The classification related back to the date of supply, and Cotspun, on approved classification lists, did not apply. The penalty was set aside because SAIL had a bona fide belief.
Issues
- Whether a Guide Car classified under sub-heading 8603.00 at the supplier's end is eligible for capital goods credit under Rule 57Q as a 'component' of the coke oven battery
- Whether the classification under sub-heading 8603.00 could apply only prospectively to supplies made earlier
- Whether penalty was justified
Provisions considered
- Rule 57Q, Table serial No. 5, Central Excise Rules, 1944Credit was claimed for the Guide Car as a component of goods eligible as capital goods. It is not an integral part without which the coke oven battery would be incomplete, so the credit was rightly denied. (¶¶ 6.1, 7, 8, 9)
- Sub-headings 8603.00 and 8428.90, Central Excise Tariff Act, 1985The classification of the Guide Car at the consignor's end under 8603.00 is final and binds the consignee, which cannot claim 8428.90. The classification relates back to the date of supply. (¶¶ 4, 6, 11)
- Rule 173Q, Central Excise Rules, 1944The penalty imposed was set aside because the assessee bona fide believed the Guide Car fell under 8428.90 or was a component of the battery. (¶¶ 3.2, 10)
Held
- A product's classification at the consignor's end is final and cannot be changed or questioned at the consignee's end. The Guide Car must therefore be treated as falling under sub-heading 8603.00, not Chapter 84. (¶¶ 6, 7)
- Following Saraswati Sugar Mills, a component is an integral part necessary to constitute the whole article, without which the article is incomplete. The Guide Car merely transports hot coke after processing, and the coke oven battery functions without it. It is distinct equipment, not a component, so no credit is available. (¶¶ 8, 9)
- Where the supplier self-assessed the goods under one heading and the authority later classified them under another, the classification relates back to the supply. Cotspun, which protected levy on an approved classification list until a show cause notice issued, is distinguishable. (¶¶ 11, 11.1)
- Since the assessee bona fide believed the goods fell under sub-heading 8428.90 or were a component of the battery, the penalty was not justified. (¶ 10)
Result
Appeal partly allowed. The denial of Modvat credit and the demand of about Rs. 45.87 lakh were upheld; the penalty of Rs. 1 lakh was set aside; no order as to costs.
